Last Minute Marvel - Terms & Conditions
- When booking a vacation week at Water's Edge from the Last Minute Marvel newsletter, renter agrees to abide by all terms & conditions herein.
- These Terms and Conditions supercede the rental agreement contained within Homeaway.com as the last minute booking and special price have slightly different conditions.
- Upon clicking the claim button the week will be temporarily reserved for 48 hours under your name. Deposit must be paid within 48 hours or the reserve will be removed and the week will be offered to the next claimant.
- Full payment of lease amount is required to be paid in full 30 days prior to the first date of stay. If first date of stay is already within the 30 day time period full payment is due within the 48 hour time period stated above.
- Those VIP Members who claim a week and do not book the week claimed have only one more opportunity to book a Last Minute Marvel - repeated claims without booking will result in removal from VIP Club.
- Water's Edge reserves the right to refuse booking at any time to any person.
- Upon deposit received the Owner agrees to ensure that the Lease Period is in the name of the Renter and to notify Renter of this. The Lease is not valid until deposit is received.
- Renter shall not sublet this Lease without Owner’s express written consent.
- Overnight guests are strictly limited to 8 persons and no guests are permitted to sleep outside of designated bedroom areas (couches, floors, etc.). Any violation of this rule will result in loss of deposit. Only those people identified as guests will be allowed occupancy. Renter agrees to abide by the policies set by the Owner, refrain from loud noise and to return the unit in clean, sanitary rentable condition or pay costs for the same. Renter is responsible for any damages.
- If Renter cancels booking at any time after the refundable deposit has been paid they forfeit the deposit. If Renter cancels within 30 days of their reserved stay then all monies paid to Owner, thus far, are forfeited. **If Owner is able to re-book the listing for the canceled dates the Renter will receive refund all of payments less the initial refundable deposit. Owner is not liable for any other costs incurred by renter outside of weekly rental rate.
- As smoking can cause foul odors and discoloration of walls, smoking on the premises is only permitted outside the dwelling unit. Renter will be responsible for any expenses incurred to cure said problems including but not limited to full-service cleaning of A/C ducts and furniture (replacement is necessary), re-painting of interior walls, and remedying of any burned areas caused by said smoking.
- Renter agrees that no pets shall be allowed in vacation property without written consent of the owner.
- Personal Property and Liability: All personal property kept by Renter in said premises shall be and remain at his/her sole risk and Owner shall not be liable for any damages to, or loss of such personal property ensuing from any acts of negligence or other persons, nor from any problems with the Property from any cause whatsoever, nor shall Owner be liable for any injury to the Renter or guests of the Renter in or about the premises. The Renter agrees to indemnify and hold harmless Owner in all such cases.
- This lease shall be governed pursuant to the laws of the Commonwealth of The Bahamas; and the invalidation of any portion of this Lease shall not invalidate the remainder. Any dispute arising under the terms of this Lease shall be referred to arbitration under the provisions of The Arbitration Act of the Commonwealth of The Bahamas.
- Owner and Renter recognize and acknowledge that there may be changes in the current tax system in the Bahamas and that there may be imposed new forms of taxes, assessments, charges, levies or fees placed on, or levied in connection with the leasing of properties in the Bahamas. All such new or increased taxes, assessments, charges levies or fees which are any and all taxes, assessments, charges, levies and fees assessed or imposed due to the existence of this Lease (including any surcharge on the income directly derived by Owner therefrom) shall be paid by Renter if incurred prior to payment of the balance of Rental Amount.
- Due to major expense we have recently needed to add a new house rule regarding our boat. The house is built along coral reefs and the dinghy is made of very hard rubber. The dinghy is incredibly sturdy - but if it is dragged along the coral or rocks with weight inside it will tear - please be careful coming in and out of the water. Please note that the use of the dinghy is now "at your own risk". We now check the dinghy prior to every check-in for damage - if the dinghy is inspected on check-out and shows any damage we will need to withhold the damage deposit to contribute to the purchase of a new one.
- This document contains the entire agreement between the parties, and any changes, amendments, or modifications hereof shall be void unless the same are in writing and signed by the parties hereto. Renter and Owner acknowledge receipt of a copy of this Short Term Rental Agreement. The parties below agree to the terms stated above and have read, understand, and agree to the terms of this agreement.
